Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ClaireCam mobile application, the Claire dashcam ecosystem, and related services (collectively, the "Services") provided by Claire Sense Inc. ("Claire," "we," "us," or "our").

By downloading, installing, or using our Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 16 years of age to use the Services. By using the Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization.

2. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You agree to provide accurate and complete information and to keep it updated.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree to use the Services only for lawful purposes and in compliance with all applicable laws, including traffic and privacy laws in your jurisdiction. You agree NOT to:

• Use the Services while driving in a manner that distracts you or endangers safety.
• Record, share, or distribute video or audio in violation of applicable privacy or surveillance laws.
• Submit false or misleading hazard reports or other community data.
• Attempt to reverse-engineer, decompile, or extract source code from the app.
• Use the Services to harass, stalk, or invade the privacy of any person.
• Circumvent, disable, or interfere with any security features of the Services.
• Use automated scripts or bots to access the Services.

4. Recording & Privacy Laws

You are solely responsible for complying with all applicable recording, surveillance, and privacy laws in your jurisdiction. Laws regarding dashcam recording, audio capture, and video sharing vary significantly by country, province/state, and municipality. Before using the recording features:

• Verify that dashcam recording is legal in your jurisdiction.
• Determine whether audio recording requires consent from all parties in your region.
• Understand any restrictions on where you may record (e.g., private property).
• Comply with data protection regulations when sharing or uploading footage.

Claire provides the mute feature to disable audio recording. We strongly recommend enabling it in jurisdictions that require all-party consent.

5. Driver Score & Safety Features

The driver scoring system, speed limit display, enforcement camera warnings, and community hazard alerts are provided for informational purposes only. These features:

• Are NOT a substitute for attentive, responsible driving.
• May contain inaccuracies due to GPS drift, outdated map data, or incomplete OpenStreetMap coverage.
• Should NOT be relied upon as the sole source of speed limit or road hazard information.
• Do not guarantee the detection of all enforcement cameras, hazards, or speed zones.

Road information prevails. Information displayed on road signs, traffic lights, posted speed limits, and instructions from law enforcement always take precedence over any information provided by the Services. In the event of a discrepancy, you must follow the information presented on the road.

You remain fully responsible for obeying all traffic laws and driving safely at all times. Claire is not liable for any traffic violations, accidents, or damages arising from reliance on these features.

6. Intellectual Property

The Services, including all software, designs, logos, trademarks, and content, are owned by Claire Sense Inc. and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for personal, non-commercial purposes.

Video recordings and telemetry data captured by you remain your property. By using the Services, you grant Claire Sense Inc. a non-exclusive, worldwide, royalty-free license to collect, store, process, anonymize, aggregate, and use data generated through your use of the Services — including telemetry, GPS trajectories, road imagery, sensor readings, and driving behavior data — for the purposes described in Section 7 below and in our Privacy Policy.

7. Data Licensing & Commercial Use

Claire Sense Inc. may anonymize, aggregate, and de-identify data derived from your use of the Services and license or sell such data to third parties, including but not limited to:

• Autonomous vehicle and advanced driver-assistance system (ADAS) developers — for training perception models, validating safety systems, and improving road scene understanding.
• Insurance companies — for anonymized driving behavior analytics, risk modeling, and actuarial analysis.
• Municipalities and government agencies — for road asset management, infrastructure condition monitoring, and traffic safety analysis.
• Mapping and navigation companies — for road network updates, speed limit verification, and point-of-interest data.

All commercially shared data is anonymized and aggregated before it leaves our systems. It cannot be used to identify you individually. Personal video footage is never sold or shared without your explicit consent. Uploaded images may be temporarily held in a secure processing queue before anonymization is applied. Faces, license plates, and other personally identifiable elements are removed or obscured before any data is permanently stored or made available to third parties.

You may opt out of contributing data to commercial programs at any time through the app settings. Opting out does not affect your access to core features of the Services.

8. Subscriptions & Payments

Certain features may require a paid subscription. Subscription terms:

• Subscriptions are billed through the Apple App Store. Apple's terms and refund policies apply.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.
• We reserve the right to change subscription pricing with 30 days' notice.
• Free tier features remain available without a subscription.

9. Community Features

If you use community features (hazard reporting, live trip sharing), you agree to:

• Submit only truthful and good-faith hazard reports.
• Not abuse the reporting system to create false alerts.
• Accept that community-reported hazards are user-generated and may be inaccurate.
• Understand that live trip sharing exposes your real-time location to anyone with the share link.

10. Data Connectivity & Costs

Certain features of the Services — including speed limit lookups, enforcement camera warnings, community hazard polling, and live trip sharing — require an active internet connection. The internet connection and any associated charges (e.g., mobile data expenses) incurred by your use of the Services are your exclusive responsibility and made solely at your expense. Data usage is governed by the agreement between you and your mobile carrier.

11. Apple Device Clause

If you use the Services on an Apple device, you agree and acknowledge that:

• Apple, Inc. bears no duties or obligations to you under these Terms, including any obligation to furnish you with Service maintenance and support.
• You will have no claims, and you waive any and all rights and causes of action against Apple with respect to the Services or these Terms, including claims related to maintenance, support, intellectual property infringement, liability, consumer protection, or regulatory compliance.
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary thereof.

12. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Services will be uninterrupted, error-free, or secure.
• Speed limit, enforcement camera, or hazard data will be accurate or complete.
• The driver score reflects an objective or legally recognized measure of driving safety.
• Recordings will be preserved in all circumstances (e.g., app crashes, storage failures).

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIRE SENSE INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF REVENUE, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

Our total aggregate liability for any claims arising from these Terms or the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Claire Sense Inc., its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, violation of these Terms, or violation of any law or third-party rights.

15. Termination

We may suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta, Canada, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Alberta, Canada.

17. Changes to These Terms

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app and on our website, with an updated "Last Updated" date. Your continued use of the Services after changes constitutes acceptance of the updated Terms.
